Workplace rules become mandatory once an employer reaches the statutory number of employees. CURRENT_THRESHOLD_NOTE Below that number they remain strongly advisable, because they are the document that defines misconduct.

Working days and hours, holidays and leave, overtime, wage payment, discipline and the complaint procedure — at minimum.

Announcement matters

Rules that were never published or made accessible to employees are difficult to enforce. Drafting is only half the exercise.

Why it matters at dismissal

Without a disciplinary code, an employer arguing that conduct was serious misconduct is arguing from first principles — usually against a written contract that says nothing about it.
