Child Legitimation

For unmarried fathers: the step that turns a biological relationship into a legal one. Without it, most parental rights do not exist.

How it works

How we run the matter

  1. Consultation on current legal status and realistic outcomes
  2. Attempt registration at the district office if consent is available
  3. If not, file a legitimation petition with the Family Court
  4. DNA testing and evidence where paternity is disputed
  5. Hearing and order
  6. Registration of the order and follow-on custody application

Documents to prepare

  • Child’s birth certificate
  • Father’s passport and, where relevant, visa records
  • Mother’s Thai ID and house registration
  • Evidence of the relationship and of support provided
  • DNA test results, where already obtained

Common questions

Being named is not the same as being the legal father. For unmarried fathers in Thailand, legal parental status generally requires legitimation by registration or court order.
The court route remains available. The child’s welfare is the governing test, and DNA evidence is commonly used.
It establishes legal parenthood. Custody and visitation are decided separately, though legitimation is usually the prerequisite.
Registration with consent is comparatively quick; a contested court application typically runs LEGITIMATION_COURT_DURATION.
